Welcome to Kwetumarket, an African B2B Marketplace. By using this platform, you agree to the terms outlined below. If you represent a company, you confirm you can bind it to this Agreement. Please read carefully, as this forms a legally binding contract.

Key Terms

• Company: Kwetumarket Ltd.
• Supplier: The business selling products on Kwetumarket.
• Customer: The individual or entity buying products through Kwetumarket.
• Products: Items listed for sale by the Supplier.
• Price: Sale price, including taxes and shipping.

Service Charge: A percentage of each transaction, agreed upon with the Supplier.

• Sign-up Fee: A non-refundable fee for creating an online store.

Services

Kwetumarket provides:

• The platforms for online product sales.
• Customer support and logistics (if opted for).
• Payment collection on behalf of the Supplier.

Suppliers must:

• Provide accurate product details (specifications), including images, pricing, and delivery timelines.
• Ensure product quality, legality, and ownership of intellectual property.
• Handle shipping within agreed timelines or opt for Kwetumarket’s logistics services.
• Resolve any customer complaints about defective or incorrect items at no extra cost.

Payment Terms

• Suppliers pay a one-time Sign-up Fee and recurring Service Charges.
• Kwetumarket deducts shipping costs and Service Charges before reimbursing suppliers.
• Payments are made within 3 to 7 working days of a consolidated sales report submission.
• Suppliers bear responsibility for applicable taxes.

Warranties and Obligations

• Suppliers guarantee the legality of their business and products.
• Suppliers are responsible for compliance with applicable laws.

Termination

Kwetumarket can suspend or terminate accounts for violations. Upon termination, outstanding dues will be settled after applicable charges are deducted.

Dispute Resolution

Disputes will be resolved through arbitration in Kigali, Rwanda. The agreement is governed by Rwandan law.

Confidentiality and Intellectual Property

Each party retains ownership of their trademarks and confidential information.

Force Majeure

Neither party is liable for delays due to unforeseen events like natural disasters or power failures.
